Anthropic wins First Amendment ruling against Department of War
Judge Rita Lin granted Anthropic summary judgment on its First Amendment challenge to the U.S. Department of War’s designation of the company as a “supply chain risk,” per Chat GPT Is Eating the World, which obtained the opinion. The designation followed a Trump administration order directing federal agencies to stop using Anthropic’s AI, after Anthropic said it opposed the military’s use of its models for autonomous weapons or mass surveillance. Judge Lin had already granted Anthropic a preliminary injunction against the designation earlier this year.
Why it matters: The ruling limits a federal agency's ability to use a contracting-adjacent label as retaliation against an AI vendor's policy stance — a tactic that could otherwise be aimed at any AI company that declines a military use case.
