News/Media Alliance opposes Databricks summary judgment bid

News/Media Alliance, the Association of American Publishers, and the International Association of Scientific, Technical & Medical Publishers filed a joint amicus brief on August 27 opposing summary judgment for Databricks and its Mosaic ML subsidiary in In re Mosaic LLM Litigation — the consolidated copyright case brought by five authors, including Stewart O’Nan and Jason Reynolds, over training the MPT and DBRX models on their books. The brief argues that copying the works for their expressive content is neither transformative nor fair use, and that market-based licensing serves publishers and AI developers alike. A summary-judgment hearing is scheduled for October 30 before Judge Charles Breyer in the Northern District of California.
